If you plan on going out this weekend, please be aware of the upcoming DUI sobriety checkpoints that may be occurring near you. While most DUI checkpoints are announced prior to their commencement, arresting officials are now trying to postpone the announcement as long as possible so that motorists do not intentionally avoid having to go through a checkpoint.   If you do not see a DUI checkpoint located in a city near you that does not mean that one might not pop up throughout the weekend. Be prepared and have a designated driver or hire a taxi if you plan on going out and drinking.

  Orange County DUI Lawyer Explains the DUI Checkpoint Crackdown in OC

The Orange County Sheriff's Department's Avoid the 38 Orange County DUI Task Force is implementing an intensive campaign to target drunk drivers during the last few weeks of summer.  These Orange County DUI sobriety checkpoints and roving DUI Patrols have begun August 19 th and will continue through September 5 th to ensure that the public is safe from motorists who may be driving under the influence of alcohol and or drugs.

According to the press release released by the Orange County Sheriff's Department, in "2009 alone, 10,839 people died in crashes in which a driver or motorcycle rider was at or above the legal limit, according to the National Highway Traffic Safety Administration (NHTSA)".

While it is unfortunately that so many individuals lost their lives due to drunk drivers, many question whether conducting DUI sobriety checkpoints in Orange County are actually beneficial. These checkpoints not only cost tax payers lots of money to run and hardly ever result in DUI arrests but rather make the city money.

  DUI Roving Patrol vs. DUI Checkpoint in California

When arresting officers announce that they will be enforcing California DUI laws and getting drunk drivers off of the streets, they usually categorize it as a DUI checkpoint or a DUI roving patrol. But what is the actual definition and difference of each? Both are designed to ensure that motorists are not driving under the influence of alcohol and or drugs but are each one is implemented in two completely different ways.

What is a DUI Checkpoint?

A California DUI Checkpoint is a structured operation that is conducted by local arresting officers to ensure that motorists are not driving while intoxicated.   These checkpoints often are set up in one location (on public streets and roadways, usually near bars or areas known for frequent DUI arrests) and must be conducted according to specific guidelines.   

During a DUI checkpoint in California, officers look for signs of intoxication such as bloodshot or watery eyes, slurred speech or even the scent of alcohol. If an officer is under the impression that you are driving drunk, they will ask motorists to step out of the vehicle and investigate by asking the driver to perform DUI field sobriety tests and a breathalyzer or blood test.

What is a DUI Roving Patrol?

Because DUI checkpoints must be announced prior to their commencement and are highly visible, DUI roving patrols in California are considered more effective in catching intoxicated drivers.  The word roving can mean nomadic, wandering and traveling which is completely different than a DUI Checkpoint which stays in one location for the duration of the operation.

 In short, Roving DUI Patrols are harder to avoid as arresting officers are not stationed in one specific area but rather are driving around the city looking for individuals who display obvious signs of driving under the influence.

  Lake Elsinore DUI Checkpoint Results in Tasered Arrest

Bryan Young, 35, was tasered and arrested after he attempted to escape officers during a routine DUI sobriety checkpoint.

According to the Lake Elsinore-Wildomar Patch, the Lake Elsinore man was about to go through a checkpoint when he made a U-turn to go in the opposite direction. Once officers approached Young, he displayed symptoms of driving under the influence of drugs and later admitted to being in possession of marijuana.

When an officer led the motorist away from his vehicle, Young attempted to run off but was stopped when a second officer tasered him.  Upon further investigation, officers found Young was a convicted felon serving probation for domestic violence and he had a loaded .38-caliber handgun as well as marijuana in his vehicle. Young has been arrested for being a felon in possession of a firearm, carrying a loaded firearm, probation violation and driving under the influence of drugs.

  Al Pacino's Daughter Arrested for DUI

Al Pacino's daughter has been arrested on suspicion of driving under the influence after she went through a DUI sobriety checkpoint.

According to the Newser, Julie Pacino was driving with an unidentified male companion in Manhattan when she went through a police checkpoint. Officers noticed signs of intoxication, such as watery and bloodshot eyes, slurred speech and the scent of alcohol, and proceeded to investigate.   The 21-year-old admitted to drinking a few beers and smoking pot hours before and has been arrested; Pacino's license has been suspended and she could be facing several charges including driving under the influence.

  7-29 Weekend DUI Checkpoints in California

Starting today and going through Sunday, there will be multiple DUI Sobriety checkpoints throughout California. These checkpoints are designed to ensure that motorists are not driving under the influence.   If you find yourself at a checkpoint, the best thing to do is remain calm and relaxed. The officer will be looking for signs of intoxication such as blood shot or blurry eyes, slurred speech and the scent of alcohol coming from the person or the vehicle.   Once these signs are observed, the officer will request that the motorists perform DUI field sobriety tests and a breathalyzer test to ensure that they are in fact under the influence.

This weekend, arresting officers will be conducting multiple DUI checkpoints throughout California, some of which have been previously announced. During these DUI sobriety checkpoints, officers look for signs of intoxication such as blurred or watery eyes, slurred speech or even the scent of alcohol.   Once officers do notice these signs, they will ask the motorist to perform a DUI field sobriety test as well as a breathalyzer test.

  What is a California DUI Checkpoint?

California DUI checkpoints are designed to protect the public from those who have been driving under the influence. A typical California DUI sobriety checkpoint is announced prior to its commencement and usually occurs in areas that are known for frequent drunk drivers or are near popular areas that have many bars and can even include looking for motorists who are driving on a suspended licenseDuring a DUI checkpoint, officers look for signs of intoxication that include blurry or bloodshot eyes, slurred speech and even the scent of alcohol coming from the person or the car.   If officers notice any of these signs, they will ask the motorist to step out of the vehicle and perform a DUI field sobriety test as well as a breathalyzer test to determine whether the driver is in fact driving under the influence of alcohol and or drugs.   

Once a driver is determined to be under the influence, they will be then arrested and will face hefty fines and license suspensions.   Unfortunately, many drivers tend to react different to an officer telling them that they may be driving under the influence or even be offended that the officer is asking to see their license.  An article on North County Times is a good example of how a regular DUI checkpoint can go wrong, causing additional drama and potential hefty when it could all have been avoided.

  Memorial Weekend Results in Multiple DUI Arrests

Memorial Day weekend is a time that friends and family gather to have a good time, barbeque and have a couple of drinks. Because most arresting officials know this, they schedule and set up multiple DUI checkpoints throughout California to ensure the safety of motorists from those who have been drinking and driving in Orange County.  These California DUI checkpoints are designed to not only protect the public but to also warn them of the seriousness and dangers that can occur when someone drinks and drives.

According to the OC Register, 148 people were arrested for driving under the influence throughout the weekend’s DUI checkpoints. Unfortunately, a teenage girl from Irvine lost her life due to an intoxicated driver who plowed his vehicle into the one girl was in early Sunday morning.   A drunk pedestrian in Fountain Valley was struck by an SUV as he crossed the street and two OC residents died in a DUI-related accident in Riverside County.

  New Bill Ensures Proper DUI Checkpoint Guidelines

DUI checkpoints are designed to protect the public from those who are driving under the influence. Arresting officers that conduct these DUI sobriety checkpoints have specific guidelines that they should follow in order for the stop and potential arrests are valid.   

Unfortunately, many officers have been known to see the guidelines as a mere suggestion and often form their own rules. Because of this, a state assembly bill has been set forth to combat these issues and provide specific guidelines and procedures that officers must follow.

According to the Pasadena Star News, DUI checkpoints are being used more as a way to generate revenue rather than to protect the public from drunk drivers.  Officers at DUI checkpoints utilize the stop to seize vehicles of drivers who are driving without licenses; in 2009 alone, more than 24,000 vehicles were impounded which is about 7 times more than the 3,200 DUI offenders who were arrested during these check points.

The new law would require police officers to follow and abide by specific guidelines that include: establish a neutral formula for inspecting motorists, use proper lights and warning signs, perform DUI checkpoints during appropriate times, notify the public of the DUI checkpoint 48 hours prior and refrain from impounding vehicles of unlicensed drivers.  

By following these guidelines, DUI checkpoints might actually become worth tax payers money as they will begin to protect the public rather than make the checkpoint a hassle for the surrounding businesses.

  Only 2 DUI Arrests Made During an Orange County DUI Checkpoint

DUI Checkpoints are designed to protect the public as well as other motorists from potentially fatal accidents. However, many times these DUI sobriety checkpoints cause more of a headache for motorists and do not net as many DUI offenders as officials would like.   Tax payers’ money ends up going towards these checkpoints but is it really worth it?

A great example comes from this weekend’s Orange County DUI checkpoint that occurred in Irvine, at Campus Drive and Bridge Road. The DUI checkpoint was scheduled for several hours near the university where one would imagine many college age kids drinking and driving.   According to the OC Register, officers stopped 545 vehicles during the scheduled OC DUI checkpoint.   Out of almost 600 vehicles that passed through, officers conducted 9 DUI sobriety field tests and only arrested 2 DUI offenders.

  California DUI Checkpoints - Waste of money?

During a DUI Checkpoint in Orange County, only 6 individuals were arrested for driving under the influence.

According to the Daily Pilot, the DUI checkpoint occurred in Costa Mesa at Newport Boulevard and 17 th Street. Out of the 2,127 vehicles that passed through the checkpoint, 9 drivers were asked to perform field sobriety tests, 12 had their licenses investigated, 13 received citations and 11 vehicles were towed.   Although DUI checkpoints may seem like they are beneficial to protecting the public from those drinking and driving, the reality is that these checkpoints are just a way for the city to make money after wasting tax payer's money.

  New DUI Checkpoint Phone Apps Waste of Money?

With all the new technology that is available, smart phone users are able to have apps that are designed to make their lives easier. But are some of the apps more dangerous than others? Consumers and politicians nationwide are looking to ban apps that are designed to warn motorists of upcoming DUI Checkpoints.

According to Fox News, there are several DUI checkpoint apps available for both the iPhone and Android phones. Although these apps are not illegal or violating any laws, they do promote motorists to check their phones while driving, putting themselves and other motorists in danger.    

Though California DUI checkpoints are designed to deter motorists from driving under the influence, they are not as cost effective as one would imagine. An example of how these DUI checkpoints are more of a money maker for the cities than a help to the community can be seen on this DUI checkpoint video.

While most DUI checkpoints must be done in accordance to specific guidelines, most arresting officers fail to follow the guidelines and in turn, end up making the motorist feel harassed and embarrassed; an example of this can be found during this DUI checkpoint audio recording.

  Police Arrest 13 Unlicensed Drivers in Courthouse Sting

Police impounded the vehicles of 13 people whose licenses were suspended or revoked for DUI offenses and were caught driving to the El Cajon courthouse Thursday to attend a mandated DUI class.

California DUI Penalties La Mesa police and county probation officers posted themselves at the courthouse parking lot entries about 3 p.m. to screen drivers going in and out, police Lt. Dan Willis said.

Willis said they timed the checkpoint for the start of a court-ordered class for those convicted of drunken driving. Over the next two hours, officers screened 171 drivers and found 13, most of them from around East County, with no valid license.

The sting is one of many operations targeting drunken drivers funded by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

The weekend is upon us and that means that cops will be out and about, patrolling cities and conducting DUI sobriety checkpoints.  The list below provides you with information on certain cities; however, it is not a complete list of California DUI checkpoints that may be in your area.   If you are going to be out drinking, designate a driver or call a taxi to make sure that you are safe.

  California DUI Checkpoints More Likely to Catch Unlicensed Drivers, Generate Huge Profits for Cities and Towns

An investigation  by California Watch and the Investigative Reporting Program at UC Berkeley’s Graduate School of Journalism last year found that sobriety checkpoints were increasingly turning into profitable operations for local police and tow companies as a result of vehicles seized from unlicensed drivers.
California DUI attorney In 2009, vehicle seizures at DUI checkpoints generated an estimated $40 million in towing fees and police fines.

Additionally, police officers received about $30 million in overtime pay for the DUI crackdowns, funded by the California Office of Traffic Safety.

The investigation resulted in the following additional findings:

  • Sobriety checkpoints frequently screen traffic within, or near, Hispanic neighborhoods. Cities where Hispanics represent a majority of the population are seizing cars at three times the rate of cities with small minority populations. In South Gate, a Los Angeles County city where Hispanics make up 92 percent of the population, police confiscated an average of 86 vehicles per operation last fiscal year.
  • The seizures appear to violate a 2005 federal appellate court ruling that determined police cannot impound cars solely because the driver is unlicensed, but should do so only when abandoning it might put the public at risk (i.e., a vehicle located in a fire lane or narrow shoulder).
  • Police across the state have ratcheted up vehicle seizures. Last year, officers impounded more than 24,000 cars and trucks at checkpoints. That total is roughly seven times higher than the 3,200 drunken driving arrests at roadway operations.
  • Departments frequently over staff checkpoints with officers, all earning overtime. The Moreno Valley Police Department in Riverside County averaged 38 officers at each operation last year, six times more than federal guidelines require. Nearly 50 other local police and sheriff’s departments averaged 20 or more officers per checkpoint; these operations averaged three DUI arrests a night.

  Costa Mesa Checkpoint Scheduled For Wednesday Evening

The Costa Mesa police department will be conducting an Orange County DUI checkpoint Wednesday evening.

According to the City of Costa Mesa press release, the check point will be on the 2300 block of Placentia Avenue between the hours of 6pm and 11pm.   During these checkpoints, officers will look for signs of intoxication and may ask motorists to conduct field sobriety tests.

  Orange County DUI Checkpoint Results

Four motorists were arrested on suspicion of driving under the influence during a DUI checkpoint in Costa Mesa over the weekend.

The Orange County Register states that on top of these 4 DUI arrests, 22 drivers were asked to do DUI field sobriety tests, 17 driver’s licenses were investigated and 11 cars were towed.  With over 429 vehicles that traveled through the checkpoint, only 1% was actually related to DUIs; this means that the grant from the Office of Traffic Safety that funds these checkpoints may not be an effect way of protecting the public from impaired drivers and may actually be wasting more money than necessary.

  America’s “Drunkest” Cities: Three California Cities in the Top Ten

Although California has some of the most severe drunk driving penalties in the country, three California cities have been ranked the “drunkest” in America.

Fresno DUI According to USA Today, Fresno will receive the dubious distinction of being named the country’s “drunkest” city in the March issue of Men’s Health magazine.

Two other cities in California—  Riverside (#4) and Bakersfield (#10)—also made the top ten.


In contrast, Boston was named the least drunk city.

To determine its rankings, the magazine used data such as death rates from alcoholic-induced liver disease, DUI-related accidents, frequency of binge drinking, number of DUI arrests, and severity of DUI penalties.

The results should not come as a total surprise to residents of Fresno. The median age in Fresno is 29, and the number of bars within 15 miles is 106, according to HomeInsight.com.

In response to the magazine’s ranking, it is likely that the city will continue to step up its efforts to combat DUI with increased sobriety checkpoints in the coming months.

  Weekend DUI Checkpoints in California

California DUI checkpoints are designed to protect the public from motorist who are driving under the influence.  When conducting these checkpoints, police officers look for signs of intoxication such as slurred speech, bloodshot or water eyes or even alcohol odor.  If officers notice any of these signs, they may require the driver to conduct DUI field sobriety tests.   Because these sobriety test must be done according to specific guidelines, there is room for error; if you have been arrested during a checkpoint or after failing a field sobriety test, contact an experienced California DUI Defense Attorney immediately.

With the weekend right around the corner, local police departments will be setting up California DUI Checkpoints throughout the state. As always, do not drink or drive; you could be putting yourself and others at serious risk of injury or even death.

  Police Arrest 11 During Checkpoint in Orange County

Huntington Beach Police made 11 DUI arrests during a California sobriety checkpoint Saturday evening.  

Between the hours of 9:30pm and 3a.m., police officers conduct 42 sobriety tests, arrested 11 drunk drivers, handed out 10 citations for driving on a suspended license and had 6 cars impounded.  According to the OC Register, officers also handed out more than 500 Project Path pamphlets information motorists of the dangers of drinking and driving.

  DUI Checkpoint this Saturday in East Long Beach

East Long Beach will be seeing a DUI check point on Saturday, January 22nd. According to the Long Beach Post, the Long Beach Police Department will be conducting driver license and driving under the influence checkpoint from 6pm until 2am.

Officers will be making sure that the public is safe by identifying offenders and getting them off the streets.  These DUI checkpoints are designed to reduce the number of persons killed or injured in alcohol involved collision.

  Unlicensed Driver Hits Officer at San Rafael DUI Checkpoint

Guillermo Garcia Rodriguez, 48, was arrested and booked into Marin County Jail on a possible felony Marin DUI causing injury on Wednesday night.  Mr. Rodriguez put his car in reverse trying to avoid a routine sobriety checkpoint. Rodriguez backed the car into a nearby gas station.  His failed attempt to escape the Marin DUI checkpoint caused Mr. Rodriguez to hit an officer that was stopped at a gas station. Upon being detained, escaping the drunk driving checkpoint turned out to be a nightmare; the suspect seemed to be intoxicated while also driving without a California license. Although Mr. Rodriguez was suspected to be under the influence, a blood alcohol test turned out to be inconclusive.  The police officer did suffer minor injuries, such as a sprain and some bruising, but was released from the hospital on Thursday.

  July 4th Weekend DUI Sobriety Checkpoints

Los Angeles drivers need to be cautious this July 4th weekend as law enforcement has planned a number of DUI checkpoints and saturation patrol units.  The Los Angeles Police Department has announced plans for a checkpoint to be located at Broadlawn Avenue and Cahuenga Boulevard.  The LAPD has also said that there will be one set up on Florence Avenue between Broadway and Main streets.  West Covina Police Department has planned a DUI checkpoint for an undisclosed location.

  Fontana DUI Checkpoint yields four arrests for driving under the influence
