  DUI on a Motorized Cooler?
Posted By Thomas V. Wallin

California DUI This story should be filed under the category of strange but true. An Australian man is facing a driving under the influence charges after being caught driving a motorized cooler box through a beachside resort town, Fox News reports.

Christopher Ian Petrie, 23, faces charges of driving under the influence and driving without a license after police caught him on the makeshift vehicle, which was powered by a 50cc engine.

Petrie's lawyers won an adjournment from magistrate John Parker as they sought to establish "whether a motorized esky [cooler box] was in fact a motor vehicle."

The magistrate was apparently amused by device and inquired with Petrie about his cooler box's performance.

"How much beer can it hold?" he asked the defendant. Petrie told the court the cooler box could hold "at least a couple of cartons."

What if this DUI arrest took place in California?

Under California Vehicle Code §670, a vehicle is defined as: "A device by which any person or property may be propelled, moved, or drawn upon a highway, excepting a device moved exclusively by human power or used exclusively upon stationary rails or tracks."

In light of the statute, the general rule is that any device with a motor that has been designed to be driven on highways is a vehicle. Therefore, it is possible that someone "driving" a motorized cooler on a California road could be arrested for driving under the influence.

While an experienced California DUI attorney could certainly challenge the arrest, it seems to make more sense to stick with a non-motorized cooler.

If you or someone you love has been arrested for drunk driving, be sure to consult with an experienced California DUI Defense attorneyas soon as possible.

Nine-Year-Old Arrested for DUI in the UK
Posted By Thomas V. Wallin

California DUI

Even though the following story does not involve a California DUI, it is a truly unbelievable drunk driving case. Luckily, this is something we rarely see in the United States.

According to The Telegraph, a nine-year-old boy has been arrested for drunk driving in Cumbria. The boy is believed to be the youngest driver held for DUI in the UK.

The boy, who cannot be named for legal reasons, was given a breathalyzer and taken into police custody. But when officers discovered his age they were forced to release him without charge because he was too young to be held legally accountable for his actions.

Safety campaigners alarmed by the child's arrest are demanding action over juvenile car crime, which apparently is a growing concern in the area.

While underage DUI is far too common in California and across the United States, the UK seems to have a much more serious problem.

If you or someone you know has been arrested for suspicion of driving under the influence in California, it is imperative to consult with an experienced DUI attorney. Contact our California DUI attorneys today.

Cases Involving San Diego Police Officer Accused of Sexual Misconduct Could Be Dismissed
Posted By Thomas V. Wallin
California DUI Attorney A San Diego police officer who specialized in DUI patrols is charged with inappropriately touching female drivers he pulled over for traffic violations.

At least four women have made complaints of sexual misconduct against Officer Anthony Arevalos, an 18-year veteran, all involving drunk driving stops in or near the Gaslamp Quarter in downtown San Diego.

•    On Feb. 20, 2010, a woman alleged Arevalos sexually assaulted her during a DUI arrest.
•    On Dec. 29, 2010, a 20-year-old woman said Officer Arevalos tried to solicit a sex act from her during a DUI stop.
•    On Feb. 20, 2011, a 25-year-old woman said she was handcuffed when Arevalos repeatedly fondled her shoulders, while pulling up the straps on her dress.
•    On March 8, 2011, a 32-year-old woman reported Arevalos sexually battered her during a DUI stop. She did not receive a citation.

Since Officer Arevalos is facing criminal charges and his credibility regarding past DUI arrests is at issue, there is a chance that open DUI cases involving the officer could be dismissed. At the least, prosecutors may be more willing to accept favorable pleas to avoid calling Arevalos to the witness stand.

In unusual circumstances such as these, it is important to have an experienced California DUI attorney.

Deputies Praised For Multiple DUI Arrests
Posted By Thomas V. Wallin

A California deputy is being recognized by the city council for her achievements, productivity and professionalism in making multiple arrests, including DUI. According to the OC Register, Deputy Christine Chang arrested three people after she found 50 heroin-filled balloons on top of other arrests throughout the year.

What most citizens do not realize, is that officers are often encouraged to be overzealous in making DUI arrests. Oftentimes, officers make up reasons for a stop, making it unlawful, and even conveniently have their patrol videos turned off until after the stop is initiated. Officers should be trained in administering DUI field sobriety tests; however, most times they do not give the proper instructions, causing the motorist to inadvertently fail the tests.

If you have been recently arrested for driving under the influence, contact our California DUI Defense Attorneys.   Our lawyers are certified by NHTSA and will be able to inform you whether your stop and arrest were done lawfully and how we will be able to help you.

California DUI Checkpoints More Likely to Catch Unlicensed Drivers, Generate Huge Profits for Cities and Towns
Posted By Thomas V. Wallin
An investigation  by California Watch and the Investigative Reporting Program at UC Berkeley’s Graduate School of Journalism last year found that sobriety checkpoints were increasingly turning into profitable operations for local police and tow companies as a result of vehicles seized from unlicensed drivers.
California DUI attorney In 2009, vehicle seizures at DUI checkpoints generated an estimated $40 million in towing fees and police fines.

Additionally, police officers received about $30 million in overtime pay for the DUI crackdowns, funded by the California Office of Traffic Safety.

The investigation resulted in the following additional findings:

  • Sobriety checkpoints frequently screen traffic within, or near, Hispanic neighborhoods. Cities where Hispanics represent a majority of the population are seizing cars at three times the rate of cities with small minority populations. In South Gate, a Los Angeles County city where Hispanics make up 92 percent of the population, police confiscated an average of 86 vehicles per operation last fiscal year.
  • The seizures appear to violate a 2005 federal appellate court ruling that determined police cannot impound cars solely because the driver is unlicensed, but should do so only when abandoning it might put the public at risk (i.e., a vehicle located in a fire lane or narrow shoulder).
  • Police across the state have ratcheted up vehicle seizures. Last year, officers impounded more than 24,000 cars and trucks at checkpoints. That total is roughly seven times higher than the 3,200 drunken driving arrests at roadway operations.
  • Departments frequently over staff checkpoints with officers, all earning overtime. The Moreno Valley Police Department in Riverside County averaged 38 officers at each operation last year, six times more than federal guidelines require. Nearly 50 other local police and sheriff’s departments averaged 20 or more officers per checkpoint; these operations averaged three DUI arrests a night.
If you or someone you know has been arrested during a sobriety checkpoint, contact a qualified California DUI attorney for more information regarding your specific case.

America’s “Drunkest” Cities: Three California Cities in the Top Ten
Posted By Thomas V. Wallin

Although California has some of the most severe drunk driving penalties in the country, three California cities have been ranked the “drunkest” in America.

Fresno DUI According to USA Today, Fresno will receive the dubious distinction of being named the country’s “drunkest” city in the March issue of Men’s Health magazine.

Two other cities in California—  Riverside (#4) and Bakersfield (#10)—also made the top ten.

In contrast, Boston was named the least drunk city.

To determine its rankings, the magazine used data such as death rates from alcoholic-induced liver disease, DUI-related accidents, frequency of binge drinking, number of DUI arrests, and severity of DUI penalties.

The results should not come as a total surprise to residents of Fresno. The median age in Fresno is 29, and the number of bars within 15 miles is 106, according to HomeInsight.com.

In response to the magazine’s ranking, it is likely that the city will continue to step up its efforts to combat DUI with increased sobriety checkpoints in the coming months.

If you or someone you know is arrested for DUI in Fresno, it is imperative to contact a qualified DUI lawyer. Call our knowledgeable Fresno DUI attorneys today.
