New Bill Makes Mothers Against Drunk Driving Mad
Posted By Thomas V. Wallin

Every year, Mothers Against Drunk Driving or MADD, rewards police officers for their efforts in minimizing drunk drivers on the road by arresting those who are driving under the influence.  So when MADD heard of a new California bill that could pass restricting the ability of officers to enforce certain laws during DUI sobriety checks, they became irate and began speaking out.

According to Mercury News, the new bill called Assembly Bill 1389, or AB 1389, condones driving without a driver's license by preventing law enforcement from enforcing current laws meant to protect people on roadways. AB 1389 would allow more driving under the influence offenders operating on a suspended license to continue to drive illegally.     DUI sobriety checkpoints are meant to protect the public but it seems as if most do not garnish as many DUI offenders as one would think.

If you have been arrested at a DUI sobriety checkpoint in CA, contact our California DUI Defense Attorneys today; we will answer any questions you may have and provide you with a free quote.

29 Year Old Woman Arrested for DUI, Drug Possession and Stealing a Vehicle
Posted By Thomas V. Wallin

An Arizona woman has been arrested on suspicion of driving under the influence after she stole a car in California.

According to ABC 15, Teresa Gregory, 29, of Prescott, Arizona, was stopped on Highway 69 for speeding. Upon further investigation, officers found she was driving without a license.   Gregory initially told officers the vehicle was hers and then changed the story, saying it belonged to a friend.   As Gregory’s passenger, 34-year-old Jason Benstead from California, was asked to step outside the vehicle, officers noticed a glass pipe on the seat and found three grams of meth underneath the passenger’s seat.

Gregory finally admitted to stealing the car in California and even stole a license plate from another vehicle to put on the stolen car.  Gregory was arrested on driving under the influence of drugs, theft of a vehicle, display of fictitious plates, possession of meth and drug paraphernalia and driving with a suspended license.   Benstead has also been arrested for theft of a vehicle and possession of meth; both Benstead and Gregory remain in custody.

Willis said they timed the checkpoint for the start of a court-ordered class for those convicted of drunken driving. Over the next two hours, officers screened 171 drivers and found 13, most of them from around East County, with no valid license.

The sting is one of many operations targeting drunken drivers funded by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

Deadliest Catch Star not charged with DUI
Posted By Thomas V. Wallin

Jake Harris, star of Deadliest Catch, was not charged with driving under the influence.  The district attorney decided against filing DUI or Hit-and-Run charges due to insufficient evidence.  Harris was charged with reckless driving and driving with a suspended license following his February 18 arrest for suspicion of drunk driving.  In the case, the supposed witness to the hit-and-run was unable to identify the driver.  The Harris family has been struck with tragedy this year as his father Captain Phil Harris, died from a stroke on February 9.

Driving under the influence in California is a very serious crime.  You are facing lengthy license suspensions, hefty fines and potential jail time.  In some cases you may not be charged with driving under the influence once all of the evidence is collected as established in the Jake Harris case, however you may still be facing very serious consequences.  Reckless driving and driving with a suspended license are misdemeanors punishable by jail time.  No matter what the circumstances of your California drunk driving arrest, and no matter what you are eventually charged with we can help.  Call us toll free today for a free initial case evaluation.
