When hiring a California Criminal Defense Lawyer to represent you, make sure that they are local to San Bernardino County.  It is vital that the attorney you hire is familiar with the  San Bernardino Superior Court system and works well with the District Attorneys and judges in the county.  In addition, make sure that you hire someone who is dedicated to Drunk Driving defense and a member of several state and local organizations.

YOU MUST CONTACT THE CALIFORNIA DEPARTMENT OF MOTOR VEHICLES WITHIN TEN CALENDAR DAYS OF YOUR ARREST OR YOUR LICENSE WILL BE AUTOMATICALLY SUSPENDED.

San Bernardino Drunk Driving APS Hearing

There are two separate hearings that occur when you are arrested for a San Bernardino DUI.  The first hearing is a criminal process through the  San Bernardino County Superior Court system described below.  The second is an Administrative Per Se (APS) hearing through the California DMV.  This hearing will determine whether the DMV will suspend your license based solely off of the arrest.  Remember you must contact the California Department of Motor Vehicles within ten calendar days to request this hearing.

San Bernardino DUI Criminal Process

The criminal process in a San Bernardino DUI case is completely independent of the DMV hearing.  The first date of the criminal proceedings is generally listed on the citation issued to you upon release from arrest for your San Bernardino Drunk Driving incident.  This date is mandatory unless you hire a qualified  San Bernardino DUI Attorney to represent you.  However, if you are arrested for a  felony San Bernardino DUI then you will have to be present at all court dates due to the gravity of the charges.  No matter what the facts of the criminal case, you should consult a San Bernardino DUI Defense Lawyer prior to making your first court appearance.

San Bernardino DUI Alcohol Programs

The California Department of Motor Vehicles may require you to complete an alcohol program in order to obtain a restricted license which allows you to drive to and from an alcohol program or within the course of work if your license has been suspended.  In addition, the court may require you to complete an alcohol program as a term of your San Bernardino DUI probation.  It is important to research the programs early and figure costs and time into your finances and schedule.  Below are a list of court approved San Bernardino Alcohol Programs.
